By using our services, you represent and warrant that you meet all of the above eligibility requirements.

6th Tally provides web design, web development, graphic design, digital marketing, web hosting, and related digital services. All services are subject to a separate written agreement or project proposal, which will take precedence in the event of any conflict with these terms.

• Service scope, deliverables, and timelines are agreed upon in a written project brief or contract.
• We reserve the right to modify, suspend, or discontinue any service at any time.
• We are not obligated to accept any project request.

You agree to use our website and services only for lawful purposes. You must not:

• Use our services for any illegal, harmful, or abusive purpose.
• Attempt to hack, reverse-engineer, or interfere with any part of our website or systems.
• Submit false, misleading, or fraudulent information.
• Infringe upon the intellectual property rights of 6th Tally or any third party.
• Use our services to create content that is defamatory, obscene, or violates any applicable laws.
• Engage in spamming, phishing, or unsolicited marketing using our platforms or contact details.

Violation of these terms may result in immediate termination of services and potential legal action.

All content on this website — including but not limited to logos, designs, text, graphics, code, and images — is the intellectual property of 6th Tally Productions or our licensors, and is protected by applicable copyright and trademark laws.

• You may not reproduce, copy, distribute, or use our content without explicit written permission.
• Upon full payment of a project, the agreed deliverables and their associated rights transfer to the client as specified in the project contract.
• 6th Tally retains the right to display completed work in our portfolio unless otherwise agreed in writing.

All payments are governed by the terms outlined in your individual project proposal or agreement. General payment terms include:

• A 50% non-refundable deposit is required before work commences.
• The remaining balance is due upon project completion, before final files or launch.
• All prices are quoted in South African Rand (ZAR) and are inclusive of VAT.
• Quoted prices are valid for 14 days from the date of the proposal.
• Payments are accepted via EFT. Proof of payment must be provided to begin work.

Refund policy: Once work has commenced, all payments are non-refundable. If a project is cancelled after work begins, any work completed up to that point remains the property of 6th Tally until the full outstanding balance is settled.

If you submit content to us (including text, images, logos, or other materials for use in your project), you confirm that:

• You own or have the legal right to use and share all submitted materials.
• The content does not infringe any third-party intellectual property rights.
• You grant 6th Tally a licence to use the submitted content solely for the purpose of delivering your project.

We reserve the right to refuse any content that we deem inappropriate, unlawful, or in violation of these terms.

Your use of our website and services is also governed by our Privacy Policy, which is incorporated into these Terms of Use by reference. The Privacy Policy explains how we collect, use, and protect your personal information.

By using our services, you consent to the data practices described in our Privacy Policy.

Our website and services are provided on an "as-is" and "as-available" basis. 6th Tally makes no warranties, express or implied, including but not limited to:

• Warranties of merchantability or fitness for a particular purpose.
• Guarantees that the website will be uninterrupted, error-free, or free from viruses.
• Guarantees regarding specific business results (such as search engine rankings or revenue growth) from our services.

While we always strive to deliver exceptional work, results may vary based on factors outside our control.

To the maximum extent permitted by law, 6th Tally Productions shall not be liable for any:

• Loss of profits, data, business, or goodwill.
• Damages resulting from third-party actions or services we integrate on your behalf.

Our total liability to any client shall not exceed the total fees paid for the specific project giving rise to the claim.

We reserve the right to suspend or terminate your access to our services at any time and for any reason, including but not limited to:

• Violation of these Terms of Use.
• Non-payment of agreed fees.
• Abusive, threatening, or disrespectful behaviour toward our team.
• Fraudulent or illegal activity.

Upon termination, any outstanding payment obligations remain in full effect.

These Terms of Use are governed by and construed in accordance with the laws of the Republic of South Africa. Any disputes arising from or in connection with these terms shall be subject to the exclusive jurisdiction of the courts of South Africa.

We will always attempt to resolve disputes amicably before pursuing formal legal proceedings.

We may update these Terms of Use from time to time to reflect changes in our practices, services, or legal requirements. When we do, we will revise the "Last updated" date at the top of this page.

Your continued use of our website or services after any such changes constitutes your acceptance of the updated Terms of Use. We encourage you to review this page periodically.
